KOMIT — Terms & Conditions

These Terms & Conditions ("Terms") form a binding agreement between you and LINX Digital Ltd governing your use of KOMIT. By creating an account, entering an access code, or otherwise using the Service, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, please do not use KOMIT.
KOMIT is currently in a closed beta. Access is granted by invitation through access codes, and the core experience is offered free of charge during this period.
1. Eligibility
You must be at least 13 years old to use KOMIT. We enforce this minimum age at signup. If you are between 13 and the age of majority in your jurisdiction, you confirm that a parent or legal guardian has reviewed and accepted these Terms on your behalf where required by local law.
- You agree to provide accurate, current, and complete information about yourself when creating an account, and to keep that information up to date.
- You may maintain one (1) account per person. Duplicate, automated, or shared accounts are not permitted.
- You must not use KOMIT if applicable law prohibits you from doing so, or if your access has previously been revoked.
2. Your account
You are responsible for activity that happens under your account. KOMIT supports Google Sign-In as an authentication option, and you may also use email-and-password credentials where offered.
- Keep your password and any linked authentication factors confidential. Do not share them with anyone.
- If you sign in with Google, you remain responsible for the security of your Google account and the permissions you grant.
- Notify us promptly at help@ikomit.com if you suspect unauthorised access, loss, or theft of your credentials.
- We are not liable for losses arising from your failure to safeguard your account.
3. The service
KOMIT is a behavioural accountability tool. It is designed to help you make commitments to people you trust, share proof when you complete them, and receive supportive nudges when you do not. It is intended for personal, lawful, and non-commercial use.
KOMIT is not medical, fitness, mental health, nutrition, financial, legal, or professional advice. Nothing in the Service is intended to diagnose, treat, cure, or prevent any condition. If you have questions about your health, wellbeing, or any commitment that may affect them, consult a qualified professional. Do not rely on KOMIT in situations where failure to perform an act could result in injury, loss, or harm.
We do not warrant or guarantee any particular outcome from using KOMIT, including but not limited to habit formation, behavioural change, productivity gains, or interpersonal results. Your results depend on you and the people you choose to be accountable to.
4. Acceptable use
KOMIT relies on healthy, consensual, and respectful interaction between users. You agree that you will not, and will not allow anyone using your account to:
- Use callouts, notifications, comments, or any other feature to harass, intimidate, threaten, stalk, dox, shame, or abuse another person. Holding someone accountable in good faith is welcome; weaponising the Service against them is not.
- Impersonate any person or entity, or misrepresent your affiliation with anyone.
- Scrape, crawl, index, mirror, or otherwise extract data from the Service by automated means without our prior written consent.
- Upload, transmit, or share content that is unlawful, sexually explicit, sexually suggestive involving minors, hateful, discriminatory, violent, deceptive, defamatory, or that infringes any intellectual property, privacy, or other right of any third party.
- Use the Service to send spam, chain messages, or unsolicited promotional content.
- Probe, scan, reverse engineer, decompile, or attempt to compromise the security or integrity of the Service, except to the extent such restriction is prohibited by applicable law.
- Use the Service to facilitate illegal activity, or to bypass sanctions, export controls, or the platform rules of Google or any other distribution partner.
We may remove content, restrict features, or suspend accounts where we reasonably believe these rules have been breached.
5. Content ownership and license
You retain ownership of the photos, videos, notes, commitments, and other content you create and upload to KOMIT ("Your Content"). KOMIT does not claim ownership of Your Content.
To operate the Service, you grant LINX Digital Ltd a worldwide, non-exclusive, royalty-free, revocable licence to host, store, transmit, reproduce, and display Your Content solely to the specific people you have a KOMIT relationship with (such as a counterparty to a commitment, callout, or accountability connection). This licence exists only so that we can deliver the Service to you and to the people you have chosen to involve.
- KOMIT is not a public feed. Your Content is shown to relationship counterparties, not to the world.
- Proof media uploaded as evidence of a completed commitment is treated as ephemeral: it is intended to be visible to your counterparties for a limited window of approximately four (4) hours from upload, after which it is no longer surfaced through the standard proof view. Counterparties may, of course, capture or remember what they have seen during that window. Do not upload anything you would not be willing to have seen and remembered.
- We will not use Your Content for advertising, sell Your Content to third parties, or use it to train external models.
- You represent and warrant that you have all rights necessary to upload Your Content and to grant the licence above.
6. Beta features
KOMIT is in closed beta. Features may change, break, or be removed without notice as we iterate. Access is granted through access codes, which are:
- Personal to you and non-transferable.
- Revocable at our discretion at any time.
- Not redeemable for cash and carry no monetary value.
Beta participants understand that the Service may contain bugs, that data may occasionally be lost, and that uptime, performance, and accuracy are not guaranteed. We appreciate your feedback and may use it to improve the product without obligation or compensation.
7. Subscriptions and billing
There are no active paid subscriptions on KOMIT today. The core Service during the closed beta is provided free of charge.
KOMIT may offer paid subscriptions or in-app purchases through Google Play in future releases. If and when paid plans are introduced:
- They will be processed through the Google Play billing system and will be subject to Google Play's payment, refund, and consumer terms in addition to these Terms.
- Pricing, features, billing periods, and renewal mechanics will be presented in-app before you complete any purchase.
- Auto-renewal, cancellation, and refund rights will be governed by the policies of the relevant app store and by mandatory consumer protection laws that apply to you.
Nothing in this section creates an obligation on KOMIT to launch paid features, nor a right for you to demand them.
8. Notifications
By using KOMIT, you consent to receive operational notifications necessary to deliver the Service. These include push notifications, in-app messages, and email related to your commitments, callouts, account security, and material changes to the Service.
- When you create a commitment that involves another KOMIT user as a counterparty, you understand and accept that the Service will notify them, including when commitments are made, completed, missed, or called out.
- If you are added as a counterparty by another user, you may receive notifications from KOMIT about their activity, subject to your notification settings on your device.
- You can manage push notifications through your device settings. Disabling notifications may degrade the experience and may cause you to miss accountability events.
9. Disclaimers
To the maximum extent permitted by law, KOMIT and the Service are provided "as is" and "as available", without warranties of any kind, whether express, implied, statutory, or otherwise.
We specifically disclaim all warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, reliability, and uninterrupted or error-free operation. We do not warrant that the Service will meet your expectations, that proof media will always be delivered, that notifications will always arrive, or that any specific behavioural change will occur as a result of using KOMIT.
Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under English law, including liability for death or personal injury caused by negligence, or fraud or fraudulent misrepresentation.
10. Limitation of liability
To the maximum extent permitted by applicable law, in no event will LINX Digital Ltd, its directors, officers, employees, affiliates, agents, contractors, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of data, loss of goodwill, business interruption, or damages arising from a counterparty's reaction to a commitment, missed callout, or proof.
Subject to the paragraph above, our total aggregate liability arising out of or relating to these Terms or your use of the Service will not exceed the greater of: (a) the amounts you have paid to KOMIT in the twelve (12) months preceding the event giving rise to the liability; or (b) one hundred United States dollars (USD $100).
The limitations in this section apply whether the alleged liability is based on contract, tort, negligence, strict liability, or any other legal theory, and even if we have been advised of the possibility of such damages.
11. Termination
You may stop using KOMIT at any time. To request deletion of your account and associated data, please email help@ikomit.com from the address associated with your account. We will action verified deletion requests within a reasonable period and in accordance with our Privacy Policy and applicable law. Certain records may be retained where we are legally required or permitted to do so (for example, to resolve disputes, prevent fraud, or comply with regulatory obligations).
We may suspend, restrict, or terminate your access to the Service, in whole or in part, with or without notice, if we reasonably believe you have breached these Terms, abused the Service, harmed another user, or created legal, security, or reputational risk for KOMIT.
Sections that by their nature should survive termination will survive, including content licences granted prior to termination for content already shared, disclaimers, limitation of liability, indemnification, and governing law.
12. Indemnification
You agree to defend, indemnify, and hold harmless LINX Digital Ltd and its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your use of the Service; (b) Your Content; (c) your breach of these Terms; (d) your violation of any law or the rights of any third party (including counterparties on KOMIT); or (e) any callout, message, or accusation you make through the Service.
We reserve the right, at our own expense, to assume the exclusive defence and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with us.
13. Changes to these Terms
We may update these Terms from time to time to reflect changes in the Service, in applicable law, or in how we operate. When we make a material change, we will update the "Effective" date at the top of this page and, where appropriate, notify you within the app or by email.
Your continued use of the Service after a change takes effect constitutes acceptance of the updated Terms. If you do not agree to the changes, you should stop using the Service and may request deletion as described in Section 11.
14. Governing law and disputes
These Terms, and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them, their subject matter, or their formation, are governed by and construed in accordance with the laws of England and Wales.
You and LINX Digital Ltd irrevocably agree that the courts of England and Wales have exclusive jurisdiction to settle any such dispute or claim. Nothing in this section affects mandatory consumer rights that apply to you under the law of your country of residence.
15. Miscellaneous
- Entire agreement. These Terms, together with the Privacy Policy and any in-app notices or supplementary terms referenced here, constitute the entire agreement between you and LINX Digital Ltd regarding the Service, and supersede any prior agreements on the same subject matter.
- Severability. If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect, and the invalid provision will be modified to the minimum extent necessary to make it enforceable while preserving its intent.
- No waiver. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
- Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms to an affiliate or in connection with a merger, acquisition, or sale of assets.
- Third parties. Except where expressly stated, these Terms do not create any rights enforceable by any person who is not a party to them under the Contracts (Rights of Third Parties) Act 1999.
- Force majeure. We are not liable for any failure or delay in performance caused by events beyond our reasonable control.
